Agreement to Terms

These Terms of Service govern your use of the Found Profits AI website and services operated by Born Company LLC ("Found Profits AI," "we," "us," or "our"). By using our services you agree to these terms in full.

Our Services

Found Profits AI provides AI-powered business assessments designed to identify inefficiencies and profit leaks in small businesses. Our services include:

• The free Profit Leak Quiz available at foundprofits.ai
• The paid AI Business Assessment ($997), which includes a Scout AI interview, a custom Profit Report delivered within 48 hours, and an optional follow-up call
• AI tool recommendations and implementation guidance

AI Interview & Call Recording

Your AI Business Assessment is conducted by Scout, an automated AI voice agent — not a live human representative. At the start of your interview, you are notified that you are speaking with an AI system and that the call is being recorded.

Calls are recorded and transcribed solely to generate your Profit Report and to improve our services. By continuing with the interview after this notification, you consent to being recorded. If you do not consent to being recorded, you may end the call at any time and contact us at hello@foundprofits.ai.

Payment Terms

The AI Business Assessment is a one-time payment of $997, processed securely through Stripe. Payment is required at the time of booking. By completing payment you agree to receive the assessment services described on our website.

What We Deliver

After completing payment and your Scout AI interview, you will receive:

• A custom Profit Report delivered to your email within 48 hours
• AI tool recommendations specific to your business and situation
• An optional free follow-up call with a Found Profits AI advisor

Delivery timelines begin after your Scout interview is completed, not after payment is received.

Accuracy of Reports

Our Profit Reports are generated using AI analysis of your interview responses. While we strive for accuracy, all dollar estimates and recommendations are projections based on industry data and your specific answers. Actual results will vary.

Found Profits AI does not guarantee specific revenue outcomes, savings, or results from implementing our recommendations. Results depend on your business, your market, and your execution.

Not Professional Advice

Our Profit Reports, assessments, and recommendations are provided for general business-improvement purposes only. They do not constitute legal, financial, tax, accounting, or other professional advice, and should not be relied upon as a substitute for advice from a qualified professional.

You are responsible for evaluating any recommendation and for the decisions you make based on it. Before implementing any recommendation that has legal, financial, or tax implications, you should consult an appropriately qualified advisor.

Consent to Communications

When you take our quiz, book an assessment, or otherwise provide your contact information, you agree that we may contact you by email, phone, and text message in connection with your assessment and our services — including to conduct your AI interview, deliver your report, and follow up with you.

Message and data rates may apply. You may opt out of marketing communications at any time by following the unsubscribe instructions in our emails or by contacting hello@foundprofits.ai. We may still send you transactional messages necessary to deliver services you have purchased.

Third-Party Tools & Services

Our recommendations may reference or involve third-party software, tools, and services. We do not control and are not responsible for the performance, availability, pricing, or policies of any third-party tool, and recommending a tool does not constitute a warranty or endorsement of it.

Your use of any third-party tool is governed by that provider's own terms and policies.

Your Responsibilities

By using our services you agree to:

• Provide accurate and truthful information during your assessment interview
• Use our reports and recommendations for lawful business purposes only
• Not share, resell, or redistribute your Profit Report without our written consent

Intellectual Property

All content on foundprofits.ai — including our assessment methodology, report formats, quiz design, and website — is owned by Born Company LLC and protected by applicable intellectual property laws. Your Profit Report is created for your use only.

Disclaimer of Warranties

Our services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that our services will be uninterrupted or error-free, or that any particular result will be achieved.

Limitation of Liability

Found Profits AI shall not be liable for any indirect, incidental, or consequential damages arising from your use of our services. Our total liability shall not exceed the amount you paid for the service giving rise to the claim.

Indemnification

You agree to indemnify and hold harmless Born Company LLC and its owners from any claims, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of our services, your violation of these Terms, or your violation of any law or the rights of any third party.

Governing Law

These Terms are governed by the laws of the State of Indiana, United States. Any disputes shall be resolved in the courts of Lake County, Indiana.

Severability & Entire Agreement

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Found Profits AI regarding your use of our website and assessment services. Separate written agreements may govern any implementation or ongoing services we provide.

Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes by posting a notice on our website. Continued use of our services after changes constitutes acceptance of the updated Terms.
